Our client was tragically killed while on SR528 while standing on the side of the road to clear some debris. The Defendant was driving eastbound in a tractor trailer. Ms. Wilt was traveling eastbound on Orange Avenue in Rockledge and stopped at a stop sign at US1 waiting for traffic to clear when she was suddenly rear ended by the Defendant. The crash resulted in $206 in damage to the rear of Ms. Wilt’s vehicle. However, severity of the injury to a person cannot always be correlated to damage to a vehicle. Ms. Wilt had no prior medical issues. As a result of the crash, she suffered injuries to her neck and right shoulder, both of which required surgery. The Defendant’s insurance company, GMAC, promptly offered their liability limits of $10,000.00. This was not enough to cover the full extent of Ms. Wilt’s injuries and fortunately she carried uninsured motorist coverage on her own auto insurance policy with Allied Property and Casualty.After receiving an offer of $35,000.00 pre-suit, David Alpizar, filed a lawsuit. After significant discovery was conducted, Alpizar Law was able to reach a settlement against Ms. Wilt’s own insurance company for $655,000.00.

Fornes v. Mijares Holding Company (Trucking Case) $1,555,000
Our client was a police deputy traveling southbound on US 441 in Indian River County. It was early in the morning and still dark outside. Defendant’s driver was northbound in a tractor trailer. As Defendant was passing our client, a wheel came off the trailer, striking the front of our client’s patrol car. Mr. Fornes suffered serious neck and back injuries with radicular pain into his arms and legs. Eventually, he required surgery to his neck. The Defendant had both an underlying insurance policy for $1,000,000 with Wausau Underwriters Insurance Company, and also had an excess insurance policy with Starstone National Insurance Company.
